When does section 433 bite and when does it let go?

Whilst case law to date had made it relatively clear that an employee’s entitlement to priority was fixed as at the ‘relevant date’, the issue of the date for fixing the property under the floating charge which might be available for priority creditor claims had been uncertain.
The session will focus on the recent decisions in Langdon, in the matter of Forge Group Ltd (Receivers and Managers Appointed) (In Liquidation)  FCA 170 and in Re Amerind Pty Ltd  VSC 127 which provide judicial clarity for banks and practitioners on this important issue as well as what assets may be caught by s433 in a trade on scenario.
