Super priority for the State: Qld environmental protection legislation trumps liquidators’ disclaimer

In Re Linc Energy Ltd (in Liq): Longley & Ors v Chief Executive Dept of Environment & Heritage Protection [2017] QSC 53, the Queensland Supreme Court has delivered a judgment which has significant consequences for the liquidation of companies exposed to enforcement measures of state governments under environmental protection legislation. 

The decision also puts liquidators on notice of their own personal exposure as ‘executive officers’ under state environmental protection legislation.
