Independence

An insolvency practitioner’s independence is always a major concern for stakeholders in an insolvency.
This course will explain your independence obligations and provide a framework to help you prepare clear, comprehensive and compliant Declarations of Independence, Relevant Relationships and Indemnities (DIRRIs) for creditors in personal and corporate insolvency appointments.
You’ll receive an overview of the guidance provided by ARITA, the regulators and courts along with key practical issues when completing DIRRIs. You’ll then use the provided checklists to complete a practical exercise.
The course materials, exercises and checklists have been updated for the 4th edition of the ARITA Code.
Learning objectives
At the end of this course you will be able to:
- Explain and apply the legal, regulatory and ARITA Code (4th edition) requirements for independence and the completion of DIRRIs.
- Utilise the provided checklists to undertake independence checks and prepare meaningful and compliant DIRRIs.

Prerequisites
We recommend you complete the Introduction to Insolvency Program, or have one year of on-the-job experience prior to attending this course.
Course format
A two-hour presentation covering the theory, plus at least one practical exercise to ensure understanding of the issues.
