Creditor claims & distributions

In corporate insolvency, creditor claims and distributions is a technical and complex area with a high reputational risk.

This course ensures participants will understand the key requirements when assessing creditors' claims and dealing with distributions. It will delve deeper into a range of more complex unsecured claims.

Other issues to be explored include how to accept or reject claims, give notice, declare a dividend and distribute to various classes of creditors; the order of priority; and classifying  circulating and non-circulating assets. This course also considers the differing circumstances in deeds of company arrangements, simplified liquidations and small business restructuring.

Learning objectives

At the end of this course you will be able to:

  • Assess a creditor claim for voting purposes.
  • Adjudicate a creditor claim for participation in a dividend.
  • Understand the order of priority.
  • Differentiate circulating and non-circulating assets and understand the impact on distribution.
  • Prepare a distribution timeline, an estimated outcome and distribution calculation.
  • Undertake a GST adjustment calculation.
  • Comply with the regulations on notice and advertising.

Prerequisites

We recommend you complete the Introduction to Insolvency Program, or have one year of on-the-job experience prior to attending this course.
