Cross-border insolvency: Overcoming obstacles to bringing proceedings in offshore jurisdictions

Bringing Proceedings against company directors and officers in connection with an offshore entity's insolvency is complex and frustrating. Liquidators are often required to overcome various preliminary hurdles before being in a position to pursue substantive proceedings.

Sally Heidenreich, of Murray Chambers, will consider two such obstacles - choice of law / forum-selection clauses and anti-suit injunctions - against the backdrop of the importance of giving effect to statutory insolvency regimes. Sally's presentation will also consider the enforcement of offshore judgments in Australia.
