Corporate Criminal Responsibility - The New Age

Recent high profile criminal charges laid against directors of failed companies and the lengthy prison sentences handed down to directors of the Kleenmaid group have raised the stakes for those who choose to engage in corporate misconduct. The noticeable increase in prosecution activity by Registered Liquidators and members of the Government's inter-agency task forces could be the new normal.

Sean Wengel and Michael Brereton will explore the application and enforcement of the individuals' criminal responsibility versus civil responsibility as highlighted in recent court decisions and legislations involving:

  • Directors duties
  • Illegal phoenix activity

  • Insolvent trading including the Substance Technologies judgment
