Gone without a trace: the assets of an insolvent trustee company
With some recent high profile collapses of financial services firms including Halifax, BBY and Courtenay House, dealing with the assets of insolvent trustee companies remains topical and gives rise to some complex issues faced by both insolvency practitioners and solicitors. Join Doran Cook SC and Michael Rose, Nine Wentworth Chambers, as they explore the legal principles, and discuss some practical tips, relating to:
- tracing the assets of a trust and claims against trust assets;
- pooling orders for mixed trust assets; and
- the salvage principle - recovering remuneration and expenses from trust assets.
