Amerind Appeal Decided - getting your priorities right!
The High Court of Australia has recently delivered its judgment on the complex question of the treatment of employee claims in the winding up of a trading trust, in the matter of Carter Hold Harvey Woodproducts Australia Pty Ltd v Commonwealth of Australia & Ors [2019] HCA 20.
The application of the statutory "waterfall" insolvency regime to recoveries from trust assets has now been determined, which now provides a measure of certainty to insolvency practitioners dealing with trustee companies.
This presentation by Harry Kay, Meyer Vandenberg Lawyers, will provide an outline of the background to the decision, discuss its significant points, and refer to issues still left to be determined in the treatment of the assets in the winding up of corporate trustees.
