Voidable transactions under the Corporations Act
Something old and something new
The modern Corporations Act has some features which are very old and some which are very new.
Barrister Scott Aspinall will first explore the heritage and continuing relevance of section 588FE(5) which permits transactions to defeat or delay creditors to be unwound.
In the second part Scott will consider the recent statutory changes which permit a liquidator to assign voidable transaction claims and some issues to consider when doing so.
