Canberra Forum: FEG Law Reform
The Corporations Amendment (Strengthening Protections for Employee Entitlements) Act 2019 was passed by Parliament on 4 April 2019. The reforms to law contained in this amending Act, which began operation on 6 April 2019, significantly strengthen the protections for the recovery of employee entitlements in insolvency.
The reforms include substantial amendments to Part 5.8A to the Corporations Act (the Part aimed at preventing the avoidance of employee entitlements), as well as the introduction of a powerful new grouping rule aimed at improving recovery of outstanding employee entitlements of an insolvent company where it was part of a corporate group or other entity group.
The session will provide background on why the reforms were made, what the key reforms to the law intend to do, and how they are expected to operate.
