Accepting and retaining an appointment as an external administrator: a deep dive into the murky waters of independence

ARITA's Code of Professional Practice state that in the context of accepting and retaining an appointment, an external administrator must be independent in fact and be seen or perceived to be independent. 

Campbell Hudson from Dentons, will consider some of the murkier issues which arise, what the Courts have to say about these matters, and provide some guidance to practitioners when confronted with allegations of lack of independence.
