The sleeping giant - s 121 transfers to defeat creditors
Commercial realities around costs and potential returns and recoveries will ordinarily direct a conservative approach to any consideration of bringing a claim under section 121 of the Bankruptcy Act. However such conservatism ought not wholly explain why so few cases under section 121 are prosecuted.
Barrister and bankruptcy law expert Peter Fary will provide an overview of the current law under section 121 and particularly its interaction with section 173 of the Property Law Act.
In the context of the classic, and not unusual example, of a person disposing of their assets on the eve of entering a business enterprise, Peter will consider whether in fact section 121 is the sleeping giant ready to be awakened.
