The new regime, proposed exemptions and likely effect

Alicia HillPrincipal at MST Lawyers, will recap the new regime introduced into the Corporations Act regarding ipso facto clauses, consider the proposed exemptions to the regime as contemplated in the draft regulations circulated for public discussion and, assuming those proposed exemptions are legislated, the likely effect for insolvency practitioners of the regime.

Alicia will give a short presentation to recap the changes and outline the proposed exemptions which will be followed by some comments from experts involved in the preparation of submissions to Treasury on the proposed exemptions. The panel will include ARITA Board member Geoff Green, whose involvement was with the Australian Banking Association submission, sharing a practitioner and ARITA Vic/Tas Division Committee perspective.
