Where are we now and where to?

The Parliamentary Joint Committee on Corporations and Financial Services - Fairness in Franchising Report, released in March 2019, has ensured that the franchising sector remains in the political spotlight. Much of this focus has been brought about by allegations that networks are structured in a way that fattens the bottom line of franchisors and leaves franchisees unable to operate profitable businesses and build saleable assests. The Report analysed why franchisees are failing, how regulation can be altered to guard against this, and what the parties' rights should be in an insolvency (or near insolvency) situation.
 
Please join Danielle Funston, Restructuring and Insolvency Partner at Maddocks, Shaun Temby, Consumer Markets and Franchising Partner at Maddocks and Morgan Kelly, Partner at Ferrier Hodgson, who will present on the following:
 
  • Look at the the current regulatory framework and slated areas of change that are relevant to insolvency practitioners and lawyers.
  • Consider the mechanics and aftermath of both a franchisee and the franchisor insolvency by addressing things such as:

    - Stakeholders' legal and practical rights.
    - How to maximise value on the sale of franchised network or individual store.
    - The practical steps that can be taken to sure up value.
    - How the current framework may change in light of the Report.
