How did we get here, what does it mean, how does it work and what are the risks for advisers?

The Safe harbour reforms provide protection for directors from a later risk of insolvent trading if they implement a course of action likely to result in a better outcome for the company.

But, why were the reforms introduced? What is a better outcome for the company? What duties do the directors owe during safe harbour and to whom? And what are the risks for advisers in navigating directors through a safe harbour scenario?

Scott Guthrie and Ben Shaw of DibbsBarker will discuss and consider these issues, as well as consider the finer points of these recent reforms to the insolvent trading laws.
