The Position of Directors during a Deed of Company Arrangement

The complexities directors face are heightened when a company is in financial distress, and their duties may continue despite being suspended during voluntary administration. Where a Deed of Company Arrangement (DoCA) follows, and subject to its specific terms, the directors' role may be revived resulting in added intricacies. Dr Beth Nosworthy, Senior Lecturer at Adelaide Law School will examine the potential pitfalls to be considered when framing of a DoCA and the position of directors during the DoCA.
