Holding DOCAs and the High Court - the beginning of the end?

The High Court has granted special leave in respect of an appeal upholding the legitimacy of a holding DOCA. Squarely in focus is whether a holding DOCA can be within the objects of Part 5.3A.
In the event the High Court circumscribes the breadth of discretion available to creditors under part 5.3A, what effect is this likely to have on other types of DOCA and on the flexibility of the voluntary administration regime – largely regarded as its principal strength?
Stephen will also discuss what other types of DOCAs are likely to be affected. And how administrators should deal with proposals in the meantime.
