Sydney Forum: Franchising in the spotlight
Where are we now and where to?
The Parliamentary Joint Committee on Corporations and Financial Services - Fairness in Franchising Report, released in March 2019, has ensured that the franchising sector remains in the political spotlight. Much of this focus has been brought about by allegations that the networks are structured in a way that fattens the bottom line of franchisors and leaves franchisees unable to operate businesses and build saleable assets. The report analysed why franchisees are failing, how regulation can be altered to guard against this, and what the parties' rights should be in an insolvency (or near insolvency) situation.
In this session we will hear from Greg Hipwell, Jessica Reid and Danielle Funston, Maddocks on:
- Look at current regulatory framework and slated areas for change that are relevant to insolvency practitioners and lawyers.
- Consider the mechanics and aftermath of both a franchisee and franchisor insolvency by addressing things such as:
- Stakeholders' legal and practical rights.
- How to maximise value on the sale of a franchised network or individual store.
- The practical steps that can be taken to shore up value.
- How the current framework may change in the light of the Report.
