Viscariello vs Macks - the final chapter
The liquidation at the centre of this judgement commenced in 2001 and spawned substantial and bitterly fought litigation. On 22 December 2017, the Full Court of the South Australian Supreme Court delivered its 140-page judgement on an appeal by the liquidator from a decision of the Supreme Court which had found him in breach of various duties.
Michael Barrett, Partner, Thomson Geer Lawyers, will review the case, covering the consideration of a series of principles relevant to the conduct of all insolvency administrations, and issues relating to the level of reliance which can be placed by an insolvency practitioner on a third party.
