Online Forum: Review of UK Insolvency Reforms

The UK’s Corporate Insolvency and Governance Act 2020 (CIGA), the most significant change to the UK’s corporate insolvency regime in 20 years, introduced three permanent measures aimed to relieve the burden on businesses both during and after the Covid-19 pandemic:
- Restructuring Plan
- Company Moratorium, and
- Restriction on Ipso Facto (Termination) clauses.
The UK Government undertook to review the three permanent measures by 26 June 2023, including commissioning the University of Wolverhampton (Prof Peter Walton and Dr Lézelle Jacobs) to provide a process evaluation of how the permanent measures have been used and received by various stakeholders. The Post-implementation Review (PIR) identified several refinements to the CIGA provisions in light of the research team’s Final Report which are designed to ensure the CIGA measures evolve to meet fully their policy objectives.
This forum will explain the most significant data and findings from the team’s Final Report and will reflect on the PIR’s recommendations for reform and what they could mean for the future of the new restructuring mechanisms in the UK. The forum will be of particular interest in an Australian context when considering the policy objectives in relation to law reform directed at the treatment of MSME insolvencies.
