Section 579E of the Corporations Act enables a liquidator to apply to the Court to have the assets of multiple companies in a corporate group ‘pooled’ so that all of the companies’ assets are cumulatively available to satisfy all of their external creditors.
Matt Simpson of LK Law will take attendees through a recently obtained pooling order identifying the procedural steps that needed to be taken, the novel points of fact and law which arose and the overall benefits to his client in pursuing this course.
